All-American Stone & Tile Care, LLC warranties only the work done by All-American Stone & Tile Care, LLC.
All-American Stone & Tile Care. LLC does not warranty the subsurface (under the tile/stone) & cannot be responsible for any issues arising from poor installation or poor care on the part of others.
All-American Stone & Tile Care, LLC work is done as a cosmetic or topical treatment within the limits of the material being serviced.
All-American Stone & Tile Care, LLC shall henceforth be referred to as AAS&TC in this document.
Invoice: Project specific instructions on final invoice should be followed or damage can occur.
Cancellation: The customer has 3 days from date of signing to cancel this contract with no obligation or 24 hours prior to start of project if less than 3 days from signing. After the 3 days have past & the customer wishes to cancel contract, a short notice cancellation fee of $325.00 plus the cost of any material ordered for your project up to the contract price would be immediately due.
Parking: It is the customers responsibility to supply fee free parking for up to 2 vehicles, depending on scope of project, or parking fees will be added to the final invoice.
Payment: This contract is binding with the “BILL TO” party listed & their authorized signature is required. Payment is required by the “BILL TO” party WITHIN the terms agreed to unless other terms have been agreed to a minimum of 7 days prior to project commencement as a contract change order. All requirements for payment processing. such as insurance certificates, must be requested prior to project commencement or can in no way impede the timeliness of payment to our office. Late payments will affect the priority & pricing of future projects. If payments are 15 or more days late according to the agreed terms an additional binding fee of 0.25% per day will apply. Under no circumstances are the terms of payment contingent on a 3rd party paying the “BILL TO” party for services related to our project scope.
Time Between Quote & Project Start: UNDER NO CIRCUMSTANCES WILL WE CLEAN UP PAINT SPILLS OR SPLATTERS OR ANY OTHER MESS OR DAMAGE TO THE SURFACES WITHIN OUR SCOPE WITHOUT SIGNIFICANT ADDITIONAL CHARGES. IT IS THE OWNER OR GENERAL CONTRACTORS RESPONSIBILITY TO CONTROL EACH CONTRACTOR & THEIR CREWS. If attempts are made by you or your agent to improve the items quoted prior to our arrival you must disclose exact changes/processes or request a new quote prior to scheduling project so we can revaluate the chemicals, manpower & equipment needed. If you fail to do so & we arrive as scheduled you will be charged a minimum 20% increase, due prior to project start, or a 4-hour minimum as described below.
Labor & Material: AAS&TC shall pay all valid charges for labor and material (except where noted in the agreement) incurred by AAS&TC & used in the construction of the project. If the customer cancels or is not available to allow access any day project is scheduled, the customer is responsible for a 4-hour minimum of $150.00 per scheduled employee, $125.00 show up fee plus any material ordered specifically for your project.
Sealing: Our Sealers will last up to 6 times the warranty term if proper cleaners & cleaning procedures are followed. Our Sealing process fills grout, stone & masonry pores & will inhibit stains such as coffee, soda, wine, fruit juice, cooking oil etc. Sealers do not repel dirt or put an end to the need for cleaning, just as stain resistant carpet needs daily ongoing care. Our Sealing process is an effective oil & water repellent. Sealing keeps contaminates at the surface, making routine cleaning simple without the use of harsh cleaners. Unless requested it will not change the appearance of grout. A quality-sealed surface allows added time to clean spills before surface becomes stained. Our sealers beading effect may end but the stain resistance is sub-surface for long lasting protection. #1 CAUSE FOR SHORTENED SEALER PROTECTION IS THE USE OF IMPROPER CLEANERS. #1 CAUSE OF SURFACE NOT REMAINING CLEAN IS IMPROPER ROUTINE CLEANING METHOD. #2 CAUSE IS IMPROPER FREQUENCY OF ROUTINE CLEANING.
Cleaning: It is possible for cement-based grout to be uneven in color for various reasons & variables. The most common reason is a bleach or acid-like cleaner used improperly in the past which damages grout pigment. We strive to return surface to its original appearance through the use of state-of-the-art, industry approved, equipment & chemicals & the processes used. On rare occasions the process you were quoted is not enough to achieve the ultimate goal due to these unforeseen variables. We will offer options, at additional cost. The test tile completed at time of quote (if any) is our best effort to be accurate but cannot represent the entire surface.
Multi-day Stain Removal: The quoted price is for 1 application. Additional applications may be necessary due to type of stone & the stain within. Results are not guaranteed due to variables beyond our control.
Stone Services: The following services can only enhance appearance & depend on the type, lot & quality of the stone you purchased or own. Each projects stone has it’s own character & cannot be changed. Polish; Increases shine (sometimes minor, sometimes a major difference), removes fine scratches or etching. / Hone; Mechanical & chemical process to provide a more even matte to low sheen appearance, depends mainly on your particular stone & the grit level chosen. / Resurface; Physically levels tile joints removing lippage, removes scratches & etching. The only area difficult to improve is under the cabinet due to the physical limits of resurfacing equipment. No matter what color your stone is, the resurfacing process may pull color from non-sanded grout, leaving it with a chalky appearance. Re-grouting of stone at additional cost may be necessary to achieve optimum appearance. We may not know until resurfacing is complete. To avoid discoloration of new grout due to moisture under stone, it may be necessary to wait 2-5 days before installing new grout. Carpet. In some cases it will be necessary for you to have a carpet professionally cleaned due to possible moisture stains. We protect against this but water is difficult to completely control. Plumbing: All plumbing fixtures & above surface sinks must be removed PRIOR to our arrival & reinstalled after completion by the customer or plumber in order to achieve optimum or even acceptable appearance around fixtures. If in the rare event we remove & reinstall fixtures, parts & labor charges will apply & we cannot be responsible for damage to fixtures Marble, Travertine, Limestone etc. are calcium-based stones. They are soft by nature & extremely sensitive to anything acidic, coffee, soda, juice, wine, etc. Once our process is complete these stones will be no more resistant to acid than they originally were. The Sealer prevents stains not etching. How careful the Customer is with any calcium based stone will dictate the rate of decline in shine & clarity. Ask about maintenance products you can utilize in addition to your cleaner, which provide a micro layer of protection to maximize your stones defense. We suggest you treat your stone with tremendous care & respect & budget for annual maintenance. Typical program would include deep cleaning, annual polishing, etch removal and sealing. Depending on traffic and environment this outline would be adjusted. Progress Payments: 10% (of total) down prior to beginning project, 40% (of total) at completion of lippage removal (leveling), 25% (of total) at completion of resurfacing & polishing, remainder due after re-grouting and/or sealing and/or caulking (unless otherwise noted).
Saltillo Pavers & Masonry: Pavers are not uniform & never will be. Properties are soft clay with a thin baked layer called the patina. Pavers stain VERY easily if not sealed & maintained. The surface is uneven & the color of each paver varies. Once the patina has been damaged its finish will vary. A sealer is for stain resistance & a surface finish (low sheen or high gloss) is to protect against physical wear. The idea is for the Finish to wear, Not the paver. If “water marks” appear after stripping, it is due to poor installation, leaving air pockets under tile, which in-turn holds the moisture from the stripping process. This can also cause added time to be required between stripping & sealing. This may also cause sporadic areas of white powder, known as efflorescence, to force it’s way to the surface. As the trapped moisture dissipates this condition will stop, however, this process may alter the surface of the paver, brick, etc….
Caulking/Re-grouting: Protection will be used to minimize dust traveling out of our work area. It is the customer’s full responsibility to close all doors & cover dust sensitive items for the duration of the re-grouting process. Even with protection, dust will travel to other areas of the job site. It is the customer’s responsibility to clean their property. The fact that AAS&TC is renewing grout damaged by movement or expansion means that this condition may continue & the cause may be subsurface. No grout or caulk has sufficient strength to stop these causes; therefore we guaranty this type of repair for 30 days after renovation has been completed. Where possible, we will use a flexible caulk that will minimize further separation. In these cases a follow up service call (additional charge may apply) to touch up Caulk will most likely solve the problem.
Clean Up: Upon completion of the work, AAS&TC will remove debris & surplus materials created by our operation from owner’s property & leave it in neat & clean condition.
Added Work: Should the owner, construction lender, or any public body or inspector direct any modification or addition to the work covered by this contract, the contract price will be adjusted accordingly. This includes but is not limited to a lack of care being taken by the responsible party to insure area to be sealed remains clean during the course of this project. Re-cleaning will result in additional cost or a voided warranty. Modification or additions to the work shall be executed only when both the owner & AAS&TC have signed a Contract Change Order. The change in the agreement price, caused by such Agreement Change Order shall be as agreed in writing, or if the parties are not in agreement as to the change in agreement price, then AAS&TC’s actual cost for all labor, equipment, subcontracts and materials, plus a fee of 20% shall be the change in agreement price. AAS&TC shall promptly notify the owner of (a) subsurface or latent physical conditions at the site differing material from those indicated in this contract, or (b) unknown physical conditions differing materially from those ordinarily encountered & generally recognized as inherent in work of the character provided for in this contract. Owner shall pay for any expense incurred due to such conditions as added work.
Warranty Terms: We do not warranty against leaks, dry rot or damage in the under structure. It is impossible for AAS&TC to know or control the care or treatment the receiver of these services will use on the tile, grout or stone after we have completed the treatment. The grout will remain clean if ordinary care is taken, proper pH neutral stone & tile cleaners are used, vacuum, vacuum, vacuum (don’t sweep) floor tile & grout & cleaning frequency is adjusted as needed. Factors to evaluate frequency of your routine cleaning are the amount of traffic, children, pets & environment. Cleaning incorrectly with non-recommended products or steam cleaners will void the warranty. Due to these variables AAS&TC must give the following limited warranty outline & conditions: Warranty is against stains not dirt or other surface build up of contaminates. Sealers are not a water barrier. Sealers are not a dirt repellant. If a stain is present you must first use the cleaners provided to you at project completion & attempt cleaning yourself. If this test is unsuccessful you must notify AAS&TC within 3 days due to the time sensitive nature of stains. If stains are numerous & widespread, this indicates an incorrect cleaner has been used which broke down the sealer & the customer did not allow AAS&TC the opportunity to solve a problem in it’s early stages. The warranty is then void. Non-sanded grout is not covered under warranty. Etching of calcium-based stone is not covered.
Mildew/Fungus etc: A constant moist environment will breed mildew. To reduce this; ventilate area, squeegee water to drain after each use, use recommended maintenance cleaner to preserve grout sealer, increase frequency of cleaning & have perimeters properly caulked. If mildew is present on the surface of your tub or shower, AAS&TC will remove it. The seeds of fungus can be behind the tile/stone structure. Due to these conditions we cannot warranty against fungus/mildew etc.
Cement-Based Grout Discoloration: Most discoloration of newly installed grout is caused by type and/or color of grout, temperature & humidity at installation or by moisture on or under the surface. Another common cause is uneven grout depth. Any variance in depth continuity will cause light to reflect oddly giving the impression of varied grout color.
Baseboards & Doorjambs: On rare occasions baseboards will warp during or after completion of a wet process such as stripping or resurfacing. It has been our findings that they return to their original shape after 2-3 weeks at which time, for a small additional fee we can return & caulk the top and/or bottom seam. If additional work must be done to address swelling, it is the customer’s responsibility to hire a skilled professional to correct these items. Warping will not occur if baseboards were properly secured at installation.
Damage Waiver: We use 14-day clean release tape wherever possible. If paint or wallpaper is damaged it is the customer’s responsibility to repair/replace. When working with tile/stone AAS&TC will exercise diligent care & expertise to avoid chipping, cracking, staining or otherwise damaging customer tile/stone. However, tile/stone may have hairline cracks or other weak areas unseen by the naked eye. If regrouting is a part of the contract AAS&TC will use care & proper tooling in removal of grout, however, chipping of tile edges due to the hardness of some grouts & required removal technique can not be determined until project commencement. Some chipping should be expected. AAS&TC will not assume liability for any accidental damage to the customer’s tile/stone during the restoration process. Plumbing: Older plumbing hook ups may be ready to break at the lightest touch due to age. If no malicious intent on the part of AAS&TC employees can be determined, it is up to the customer to repair or replace the fixture or hook up as part of the normal course of property ownership.
Delay: Estimated number of days to complete project is approximate & may change if added time is needed to achieve desired results. AAS&TC shall be excused for any delay in completion of the contract caused by acts of God, acts of the owner or the owner’s agent, employee or independent contractor, stormy weather, labor trouble, acts of public utilities, extra work, or failure of the owner to make progress payments promptly, or other contingencies unforeseeable by or beyond the reasonable control of AAS&TC.
Insurance: Responsible party for payment will be responsible to procure at his own expense & before the commencement of any work hereunder, fire insurance with course of construction, vandalism, theft & malicious mischief clauses attached. If the project is destroyed or damaged by an accident, disaster, or calamity, such as fire, storm, flood, landslide, subsidence, or earthquake, or by theft or by vandalism, responsible party for payment & property owner shall pay for any work done in restoring the project & to cover work completed to that point. Responsible party for payment & Property owner shall obtain & pay for insurance against injury to his own employees & persons under their direction or on the job site at their invitation.
Right to Stop Work: AAS&TC shall have the right to stop work if any payment shall not be made timely to AAS&TC under this agreement, AAS&TC may keep the job idle until all payments due are received (cost will increase accordingly due to “Added Work” clause). In addition, AAS&TC may at our option terminate the agreement if the customer is rude, delusional, violent, demands added work at no additional charge, changes desired result of project after project has begun or demands multiple test areas after project has begun. . The owner shall be liable to AAS&TC for breach of this agreement up to the full contract price, depending on percentage of project completed, including total man-hours on-site & loading & material used.
Refund Policy: A refund will be issued if the Contract could not be fulfilled by AAS&TC & no other clauses in this contract apply & Customer fraud is not evident.
Payment Dispute: If payment for this contract is received & later revoked either by Stop Payment on a check or Dispute of the credit card charge & charges are later found to be contractually correct by the Financial Institution, Credit Card Company or the Court of Law, binding additional fees are $325.00 plus documented expenses related to dispute & $175.00 per hour dispute preparation charge per dispute.
Arbitration for projects in excess of current small claims court limit or at the discretion of AAS&TC: Any controversy or claim arising out of or relating to this agreement, or the breach thereof, shall be settled by binding arbitration & judgment upon the award rendered by a licensed Arbitrator selected by AAS&TC & may be entered in any court having jurisdiction thereof. If the customer refuses or neglects to participate in the arbitration process within thirty (30) days after receiving notice thereof, the Arbitrator is empowered to decide the controversy in accordance with whatever evidence is presented. The Arbitrator is authorized to award reasonable costs, expenses & attorneys fees. Any decision of this Arbitrator shall be binding. If judgment is awarded to AAS&TC, this judgment must be received in our office within 30 days or a 21.99% APR from the original contract due date will be due & binding. The party responsible for payment understands that any dispute will be settled in the Court having jurisdiction in the City and/or County of the AAS&TC billing office.
Limitations: The customer shall commence no action of any character arising from or related to this agreement, or the performance, more than 180 days after completion or cessation of work.
